<i>SITE C: IN SEARCH OF INVESTIGATIVE CHAMPIONS ! </i><br />

Peter O'Neill of the Vancouver Sun did a special report Sept 12, 2015 on steps taken by Canada and BC to attempt to salvage water sovereignty in the face of NAFTA. Reading it,
the average person might feel relieved. But the truth lies in
his closing quote by a senior trade lawyer who "... can foresee
a winnable case before the World Trade Organization arguing the
absence of restrictions in Canada on bulk withdrawals for domestic
uses means that export restrictions are merely disguised trade
restrictions rather than bona fide conservation measures..." <br />
<br />
Full NAFTA rights (goods, services, investments) of course accrue to all water
licenses held by American firms or firms with American investors.
NAFTA trumps all attempts to remedy this by Canada's federal and
provincial courts. They offer good optics but little more. <br />
<br />
I suggest continental water sharing was USACE's "100 year" game
plan. We are 66 years in. All annoying "sovereignty" issues
("risks") have been resolved by NAFTA; which ensures investor rights
dominate. As water becomes an increasingly precious resource (no
substitutes), feasibility horizons shift in response to new
economics. What was thought of as "off the table" is suddenly "on"
again... <br />
<br />

If built, Site C will supply water and energy for fracking the Moberley field (projected to be North America's largest) in the
medium term. In the longer term, the Site C dam on BC's Peace
River adds, through river engineering, the last piece of
infrastructure to ensure American
communities don't run out of water (which is <i>after all </i>"mostly American"

Whether you believe this is <i>far fetched</i> or <i>right on</i>,
there is enough evidence on the table to warrant a referral to the BC Utilities Commission where transparent and
informed public discussion can occur.
All work on Site C must stop while this proceeds.<br />

sheep. We are active and informed community members standing up
for community rights of participation in decisions impacting our
natural resources - our commons.<br />

In my mind,
when it comes to the construction of Site C on BC's Peace River, water is clearly the end game. <br />
<br />
I am a 20 year columnist with the Canadian farm press and a member of Canadian Association of Journalists. As a Professional Agrologist (now retired), I
provided expert testimony to the federal provincial Environmental
Impact Assessment panel on the agricultural impact of the proposed
Site C dam to be built in BC's Peace River.<br />
<br />
Below is an excerpt of a statement from the National Farmers Union in
opposition to the dam: <br />

The economics make no sense. The energy is not needed. Yet, in the face of massive and across-the-board opposition (from Treaty 8 First Nations,
the farm community, the business community, the energy community,
the environmental community and the general public; the Sierra Club,
the David Suzuki Foundation, Lawyers Rights Watch, the BC Wilderness
Committee, the Royal Society of Canada, BCGEU, SPEC, the National
Farmers Union, KAIROS and others), the BC government is rushing - pending law suits be damned - to "get to
the point of no return" on the Site C dam so it cannot be stopped...<br />
<br />
Why would a government fly in the face of <i>all
that is fiscally and politically prudent?</i> Here is where the story
gets interesting...<br />
<br />
Back in the 1950's, the US Army
Corps of Engineers was tasked with
the job of "not letting America run out of water". Shortly
thereafter, water resources in the north were "mapped" and shortly thereafter the BC government placed flood reserves on British Columbia's Peace
and Columbia
River basins. <br />
<br />
Continental water sharing
is based on catch and release - pondage to collect water behind dams
and release it downstream when needed. Every engineering scheme
ever tabled to deliver the "benefits" of continental "water sharing"
(diverting rivers in the north to fill rivers in the south) uses the Columbia River to bring water west of the Rockies and the Peace River to bring it east of the Rockies. The dams on the
Columbia already exist. Site C is the last piece of the puzzle in
the
north.<br />
<br />
But surely big scale water diversions like NAWAPA are "old ideas?" Perhaps. There will of course be no large scale
destruction of Canadian towns to turn the Rocky Mountain Trench into
a giant reservoir.<br />
<br />
But to assume the idea of continental water sharing is dead is to misunderstand the
economic power of a resource with no substitutes, unlimited demand
and dwindling supply. <br />
<br />
What if USACE were working on a 100-year plan? The trade agreements
had to be first signed to make water (and water licenses) subject to the
goods, services and investment provisions of FTA and NAFTA with all
the rights that so attach. Get the public to shoulder the cost of
Site C ($8+ billion just the starting point). Then bankrupt BC
Hydro to deliver a once solid crown corporation into the sweaty
palms of the private sector, full water rights attached. <br />
<br />
As
Tom Kierans (Grand Canal proponent; Simon
Reisman - before being appointed Canada's trade negotiator - was Kierans shill boy for the project) said of the Rafferty Alameda dam: "
there is no
agenda at all; it just "happens" to be in the right place (for
continental water sharing projects). <br />
<br />
Far fetched? Perhaps. But then again, perhaps not. <br />
<br />

One said: "...you have to realize that to some, this is gonna sound like a good idea. <i>'It's just plumbing...</i>' You have to start with why large-scale, intra-basin water diversions are bad...<br />
IN BRIEF: Sustainability means learning to live within the capacity of our existing systems, which include our drainage basins. If that means farmers can't grow rice in California, so be it. We need to adapt our needs to fit our capacity, not the other way around. Water that flows to the sea is not "wasted" - it supports a rich marine community. The transfer of water from one drainage basin to another upsets the fragile balance of eco-systems. And threatens the sustainability of communities. <br />
<br />
The fertile alluvial soils of the east-west running Peace Valley need to be placed in permanent commons covenant and dedicated to the production of organic fresh vegetables for communities, with a priority to those in the North. <br />
<br />
Like the Rafferty Alameda Dam, SITE C, if built, places a very strategic pearl on the carefully draped necklace of continental water sharing schemes. SITE C is EXACTLY (geography 101!) where every diversion scheme ever envisaged places it to catch and release water into the Prairies an onward to the US and Ontario.<br />

Will be watching at 12:30 today as HMCS Annapolis is sunk to become
BC's newest marine reef.<br />
<br />
My dad was in the US Navy, so I felt drawn to
learn more about this grand old vessel lying in final harbour outside my
window.<br />
<br />
Her keel was laid in a Halifax shipyard in 1961 and she launched
in 1963. Interestingly she was the second Canadian vessel carrying the
Annapolis name. The FIRST was a 1918 destroyer purchased by Canada from
the US Navy in 1940 and - per a protocol of that purchase - given a new
name reflective of cities in both countries...<br />

Thanks to @LawDeanHolloway for filling in that she was the first purpose-built helicopter destroyer in the RCN. <br />

Today's HMCS Annapolis
spent most of her life as a training ship on Canada's east and west
coasts. She was apparently the first Canadian ship to carry a
mixed-gender crew.<br />
<br />
Onward Annapolis to your final berth. Her predecessor was towed to Breaker's Yard in Boston for scrap. Sensitively sunk (apparently all toxic materials removed except the paint) to become a new home for baby
octopi sounds like a much more relaxing retirement. <br />

Site C is really all about water. <br />

Maps prepared for me by geography students at the University of Winnipeg (my book <i>Water and Free Trade</i> Lorimer, 1988 was required reading; their teacher thought preparing these maps would be a worthy project), show this oh-so-clearly. One map shows North American rivers and the other (colour coded) continental diversion schemes. Semi transparent, they are perfect overlays. <br />

Every continental water sharing plan <u>ever devised</u> uses the natural geography of the Peace River Valley to bring water into the western prairies and eastern Canada and the United States. <br />

Put it in vegetables under an enduring covenant (this fertile bottom land is capable of meeting the nutritional needs of over one million people per year) and continental water sharing is off the table. Period. And with it all the mega projects. Are we clear now why BC Government is behind it? Even if some really don't understand why, politicians have been given their marching orders when it comes to Site C. Nothing must stop it. And now we understand why.<br />

Let's haul out the maps, whistle up all those investigative journalists out there, and have a community discussion on this. If government doesn't listen, lie down with me in front of heavy equipment until they do.<br />

Things are not going well for SNC Lavalin. Today's news falls on the heels of last years announcement by the World Bank that SNC Lavalin and all its subsidiaries were placed on a 10 year funding blacklist. This resulted in cross-debarment by African Development Bank,
Asian Development Bank, Inter-American Development Bank and European
Bank for Reconstruction and Development. According to Business in Vancouver April 17, 2013: <br />

There is another
aspect to this. Back in 1988, in preparation for the book Water and
Free Trade (Lorimer, Toronto, 1988), I had two maps prepared - one
showing all North American river systems and the other showing - in
different colours - the half dozen or so major water diversion schemes
to get Canada's water south. Pooh-poohed as a ridiculous idea by those
who saw water and the trade rights attached as a Free Trade Agreement
stumbling block (read the book!) it likely contributed to the
resignation of Pat Carney as Canada's Trade Minister (I believe she did
not know) was dismissed by her successor John Crosby with a "lard
tunderin' jaysus." Since then, full FTA and NAFTA National Treatment
rights ascribe to water use in Canada (e.g. fracking) when the investors
are American. And digging out those two maps and hanging them on my
wall, DANG but it's interesting to see how SITE C is exactly where it
should be (as is Williston) to deliver the water goodies, thru pipelines

Facilitated by a government so bereft of their own ideas they buy into those hawked by extractionists, we are trading short term jobs for tomorrow. <br />
<br />
IF WE MANAGE TO STOP this runaway train, we have to recognize that
this is, in part, a property rights issue . We need to recognize that resources considered to be "in the commons" (farmland, water) have ownership rights that extend far beyond any existing fee simple title. <br />
<br />
For example, our existing system of land tenure assumes the entity that holds title (could be individual, could be government) can withdraw that property from the commons (e.g. flood Peace River farmland), convert it to another use (water storage) and capture its value today (fracking) without any consideration of the rights of the tomorrow.<br />
<br />
For resources such as farmland - laid down by natural processes over the milenia and critical to food security - fee simple title should be converted (through purchase) to long term (e.g. 100 year) "usufruct" tenures that the lessor agrees to manage sustainably, growing the value of the commons. <br />
<br />
Because we want affordable food, lease payments would be minimal or perhaps even negative, reflective of stewardship that results in higher soil fertility.<br />
<br />
The public purse would take the hit today of acquiring the land. And that would be that. It would be forever protected.<br />
<br />

reserves of 449 trillion cubic feet of marketable natural gas, 14,521
million barrels of marketable natural gas liquids (NGLs) and 1,125
million barrels of oil.</i><br />

<i>The Montney Formation is the largest shale
gas deposit in British Columbia. It straddles the Alberta-BC border;
and is next to numerous other shale gas deposits on both sides of the
border. At present, there is a gold rush mentality related to the
Montney Formation, with <a href="http://www.vancouversun.com/sports/Montney+firms+buyers+developments+take+shape/10095575/story.html" target="_blank">fracking companies falling all over</a> themselves to draw in new business. </i><br />

Just back from a month in Havana and delighted to see the progress that has been made in the SITE C debate.<br />
<br />
Surprised tho to see discussion "stuck" in the bean counter stage. Yes, we now <i>all know</i> there is no economic justification for Site C. Promising power at four times market price, this project has no business going ahead. We get it. <br />
<br />
Time to move on: the really critical issue here is FOOD. <br />
<br />
The land to be flooded for SITE C is capable of producing fresh fruits and vegetables for one million people. ONE MILLION PEOPLE. Essential (pssst! that means we can't do without them...) human nutrients<i> ONLY AVAILABLE </i>from fresh fruits and vegetables. <br />
<br />
In the face of soil salinization, erosion, topsoil depletion, desertification, water shortages, fossil fuel depletion, climate change and population increase, where do we suppose these fresh fruits and vegetables are going to come from?<br />
<br />
Some 200 km closer to Vancouver than are California veggies, fresh Peace River fruits and vegetables are also of key strategic importance to health outcomes in Canada's North.<br />
<br />
What value do we place on growing strong and healthy children?<br />
<br />
This is beyond the ken of the bean-counters. It is the job of leaders. And assertive communities. Yay the commons! Yay us...<br />

expensive than today's power costs. And that's without inevitable cost
overruns. And without taking into account the errors introduced by

In all this discussion of election reform, the myth that a multi-party system is a necessary component of democracy warrants examination.<br />
<br />
What about a "no-party" system?<br />
<br />
In Cuba, people from the neighbourhoods propose candidates from their community whom they believe to be good and fair and responsible people. Each candidate's picture along with a short statement of their background (all together on one 8.5 by 11 inch sheet of paper!) is posted along with that of other would-be candidates in a prominent neighbourhood gathering place. <br />
<br />
On election day, people go to their polling station and vote by secret ballot for their local representative to the municipal assembly. Cuban elementary students in their red and white school uniforms "guard" the ballot boxes, standing in front of each and saluting every person as they vote. Cuban voter turnout is normally over 98%. <br />
<br />
Candidates who have been elected at the municipal level elect representatives to the provincial assembly, who in turn elect candidates to serve on the national assembly. The members of the provincial and national assemblies elect their president, who then proposes a cabinet of ministers. The ministers proposed must be voted on by the assembly. <br />
<br />
The Communist Party of Cuba takes no part in the elections. Nor do you need to be a member of the Party to be elected. The percentage of women elected to office is very high - 45.2 percent . We in Canada can only dream of such numbers...<br />
<br />
Unless they agree to take on a cabinet post, men and women who serve as elected representatives are not paid any additional salary - they keep their day job. It is considered service to their community. <br />
<br />
Cuba's mass organizations (sort of like trade unions - they are profession or sector-focused and represent for example workers, writers and artists, farmers, youth, women, etc. - there are as i recall 13) also propose representatives to serve in government. <br />
<br />
The result of this process is a government that is accountable and diverse, representing all sectors of society.<br />
<br />
My dear friend the late Canadian Ambassador Kenneth Wardroper said the Cuban system, based on a pyramid system, was in fact a very democratic system.<br />

BC Peace River's Site C is a perfect example. This province wants to build a huge dam (jobs! jobs! jobs!) that will destroy our northern vegetable garden (capable of providing fresh, local vegetables to over 1 million people) to produce power for export.<br />
<br />
Once the dam is built, pack up the family and kids and move on to the next maga-project site. <br />
<br />
It's about "creating jobs" now and ensuring poverty later. Who calls these clowns to account? <br />
<br />
Our farmland is our grocery store. It is the property of the commons. Natural capital. Yet this government presumes to now divide that resource into "important" and "unimportant". Nothing to do of course with where the voters live (South). And where they want to get at the resources (North). Eighty-five percent of our best agricultural land lies in Zone 2, which will be less protected.<br />
<br />
The fact that we have a government in Victoria that feels itself immune to our censure, above our input and beyond our control is the problem.<br />

<span style="font-size: small;"><span style="font-family: Arial,Helvetica,sans-serif;">How convenient that yesterday's changes to the provincial land reserve opening the northern half of British Columbia for development are announced by Victoria on the eve of the CEAA/EAO Joint Review Panel’s recommendation on Site C Dam. <br /><br />If it goes ahead, the building of Site C dam will impact 12,759 hectares (31,528 acres) of class 1-7 land in BC’s Peace River Valley. These rich aluvial soils, unique class one micro-climate and long growing days makes this land capable of producing enough fresh vegetables for over one million people. </span></span><br />
<br />
<span style="font-size: small;"><span style="font-family: Arial,Helvetica,sans-serif;">It is the only large tract of undeveloped vegetable land left in the province and we are 50% deficient in vegetable production. This land represents natural capital owned by future generations. It is not the property of BC Hydro to flood for export power. <br /><br />Flooding these fertile farmlands will undermine provincial food security, reduce access to nutrition (affordability), and impact the health of northern communities. <br /><br />This rich alluvial farmland with unique microclimate is part of BC’s natural capital. It belongs to the commons, which belongs to the future... It is not BC Hydro's to harvest.</span></span><br />
